Algemene voorwaarden Hotdoghouse Curated Dog Nanny
Artikel 1: Definities en algemeen
In deze Gebruikersvoorwaarden worden de volgende begrippen/definities gehanteerd:
Hotdoghouse Curated Dog Nanny: Hotdoghouse B.V., gevestigd aan [adres], met Kamer van Koophandel nummer 89066677, tel. [telefoonnummer], e-mail: info@hotdoghouse.nl. Hotdoghouse Curated Dog Nanny beheert de website / het online platform www.hotdoghouse.com voor (al dan niet flexibele) hondenoppasdiensten, ook wel aangeduid als het Platform.
Gebruiker: iedere eigenaar van een hond (Ouder) en iedere hondenoppas (Nanny) die zich heeft geregistreerd op het Platform en gebruik maakt van de faciliteiten van het Platform.
Gebruikersprofiel: het online profiel waarmee de Gebruiker zich registreert op het Platform.
Gebruikersovereenkomst: iedere overeenkomst tussen Hotdoghouse Curated Dog Nanny en de Gebruiker die automatisch tot stand komt door middel en op het moment van registratie door de Gebruiker op het Platform, op grond waarvan Hotdoghouse Curated Dog Nanny de Gebruiker toegang verleent tot het Platform en de Gebruiker gebruik laat maken van de faciliteiten van het Platform. De Gebruikersovereenkomst is een overeenkomst op afstand en behelst geen afzonderlijke schriftelijke overeenkomst tussen Hotdoghouse Curated Dog Nanny en de Gebruiker.
Gebruikersvoorwaarden: deze algemene voorwaarden, d.w.z. de voorwaarden die van toepassing zijn op ieder gebruik (zowel via de computer als via mobiele apparatuur of enige andere softwareapplicatie) van het Platform door een Gebruiker en (daarmee) ook op de Gebruikersovereenkomst.
Nanny: een particulier die zich heeft ingeschreven op het Platform, die flexibele hondenoppasdiensten via het Platform kan verlenen.
Oppasovereenkomst: de overeenkomst(en) met betrekking tot een hondenoppasdienst tussen de Ouder en de Nanny die via het Platform tot stand is gekomen.
Oppasdienst: iedere op grond van de Oppasovereenkomst te leveren (of geleverde) hondenoppasdienst die via het Platform tot stand is gekomen en die eruit bestaat dat een Nanny past op een of meer honden van de Ouder(s).
Ouder(s): de eigenaar(s) van de honden, die een particulier zijn en zich heeft/have ingeschreven op het Platform.
Payment Provider: de door Hotdoghouse Curated Dog Nanny ingeschakelde betalingsdienstaanbieder, thans [betalersnaam], die het betalingsverkeer via het Platform voor de via het Platform tot stand gekomen Oppasdiensten regelt.
Platform: het online platform www.hotdoghouse.com voor hondenoppasdiensten van
Hotdoghouse Curated Dog Nanny.
Voltooid (of voltooide Oppasdienst): het door de Nanny volbrengen (en daarmee eindigen) van de Oppasdienst.
Deze Gebruikersvoorwaarden zijn van toepassing op ieder gebruik van het Platform en op iedere aanbieding en/of nadere (Gebruikers)overeenkomst, tussen Hotdoghouse Curated Dog Nanny en een Gebruiker, voor zover van deze voorwaarden niet door partijen uitdrukkelijk en schriftelijk is afgeweken.
Hotdoghouse Curated Dog Nanny biedt haar Platform, onder meer, aan voor het bij elkaar brengen van vraag en aanbod op het gebied van hondenoppasdiensten door Gebruikers. Hotdoghouse Curated Dog Nanny faciliteert daarnaast via het Platform en een geautomatiseerde zoekmodule waar de Ouder en de Nanny tot aanbod en aanvaarding (over een Oppasdienst) kunnen komen. Via het Platform kan de Ouder ook tot betaling overgaan. Hotdoghouse Curated Dog Nanny stelt slechts het Platform en de geautomatiseerde zoekmachine ter beschikking. Hotdoghouse Curated Dog Nanny en/of haar medewerkers bieden zelf geen hondenoppasdiensten aan.
Artikel 2: Gebruikersovereenkomst, registratie en gebruik
1. Voordat de Gebruikersovereenkomst tussen partijen wordt gesloten, wordt de tekst van deze algemene voorwaarden aan de Gebruiker beschikbaar gesteld. 2. De tekst van deze Gebruikersvoorwaarden worden langs elektronische weg aan de Gebruiker ter beschikking gesteld op zodanige wijze dat deze door de Gebruiker op een eenvoudige manier kan worden opgeslagen. Indien dit redelijkerwijs niet mogelijk is, zal voordat de Gebruikersovereenkomst wordt gesloten, worden aangegeven op welke manier van de Gebruikersvoorwaarden langs elektronische weg kan worden kennisgenomen en dat zij op verzoek van de Gebruiker langs de elektronische weg of op andere wijze kosteloos zullen worden toegezonden.
3. Deze Gebruikersvoorwaarden zijn integraal van toepassing op iedere Gebruikersovereenkomst en worden middels registratie op het Platform door de Gebruiker geaccepteerd.
4. De Gebruiker vult het Gebruikersprofiel naar waarheid, actualiteit en volledigheid in, accepteert de Gebruikersvoorwaarden en de privacyverklaring van Hotdoghouse Curated Dog Nanny en stelt het Gebruikersprofiel ter beschikking aan Hotdoghouse Curated Dog Nanny voor verdere verwerking op het Platform. De Gebruiker is gehouden alle relevante informatie te verstrekken die aan hem of haar wordt gevraagd. De Ouder dient een keuze te maken voor een membership. De Nanny dient zijn of haar tarieven op te geven in het Gebruikersprofiel en is zelf verantwoordelijk voor het vaststellen van die tarieven. De Gebruiker is verantwoordelijk voor het up-to-date houden van het Gebruikersprofiel.
5. Hotdoghouse Curated Dog Nanny’s verzameling en gebruik van (persoonlijke) informatie in verband met de toegang tot en gebruik van het Platform wordt beschreven in de privacyverklaring. Hotdoghouse Curated Dog Nanny zal deze gegevens, inclusief de informatie over de door de Gebruiker geboekte dan wel geleverde diensten, gedurende de looptijd van de Gebruikersovereenkomst ter inzage bewaren in het Gebruikersprofiel, en Gebruiker de mogelijkheid bieden om persoonlijke gegevens aan te passen. De Gebruiker heeft toegang tot dit gedeelte van het Platform door in te loggen met zijn of haar persoonlijke e-mailadres en
wachtwoord.
6. Hotdoghouse Curated Dog Nanny stuurt vervolgens via een (automatische) e-mail een bevestiging van de registratie van Gebruiker, het gekozen membership (voor zover van toepassing) en de acceptatie door de Gebruiker van de
Gebruikersvoorwaarden en de privacyverklaring. Met de registratie is de Gebruikersovereenkomst automatisch tussen de Gebruiker en Hotdoghouse Curated Dog Nanny tot stand gekomen, waarop deze Gebruikersvoorwaarden van toepassing zijn.
7. De Gebruiker heeft de mogelijkheid zijn of haar Gebruikersprofiel te bewerken en (voor zover van toepassing) voor een ander membership te kiezen. De Gebruiker is zelf verantwoordelijk voor de juistheid en volledigheid van de gegevens in het Gebruikersprofiel.
8. Het Gebruikersprofiel noch de Gebruikersovereenkomst is aan derden overdraagbaar. Iedere Gebruiker mag slechts gebruikmaken van één
Gebruikersprofiel. Hotdoghouse Curated Dog Nanny behoudt zich het recht voor om, zonder opgave van redenen, een Gebruikersprofiel te verwijderen en Gebruiker de toegang tot het Platform te weigeren. Het is een verwijderde Gebruiker niet toegestaan een nieuw Gebruikersprofiel aan te maken zonder voorafgaande schriftelijke toestemming van Hotdoghouse Curated Dog Nanny.
9. Hotdoghouse Curated Dog Nanny is te allen tijde gerechtigd om zonder opgaaf van redenen, functies van het Platform te veranderen, te verwijderen of nieuwe functies in te voegen (bijvoorbeeld door het gebruik van functies slechts onder bepaalde omstandigheden mogelijk te maken).
Artikel 3: Toelichting op de Oppasovereenkomst
1. Hotdoghouse Curated Dog Nanny biedt de Ouders tegen betaling van een vergoeding de mogelijkheid zich met een Gebruikersprofiel te registreren, het Platform te gebruiken om een Nanny te zoeken middels de geautomatiseerde zoekmodule en boekingsverzoeken in te dienen bij een Nanny. Het Platform biedt de Nanny de mogelijkheid kenbaar te maken op welke data en tijdstippen hij/zij beschikbaar is om hondenoppasdiensten te verlenen.
2. Het Platform stuurt de boekingsaanvraag van de Ouder automatisch door aan de betreffende Nanny. De aangevraagde Nanny bepaalt geheel autonoom of zij de hondenoppasdienst in overeenstemming met de boekingsaanvraag zal vervullen. De Ouder zal zelfstandig instructies ten aanzien van de te verrichten Oppasdiensten aan de Nanny geven. Hotdoghouse Curated Dog Nanny garandeert niet (en kan ook niet garanderen) dat boekingsverzoeken van Ouders vervuld zullen worden en kan hier ook niet voor aansprakelijk gehouden worden. Wijst een Nanny de boekingsaanvraag af, dan kan de Ouder via het Platform opnieuw een passende Nanny zoeken en boeken.
3. De Nanny zal de hondenoppasdienst verrichten op basis van een (bijzondere) arbeidsovereenkomst onder toepassing van de Regeling Dienstverlening aan huis, ervan uitgaande dat de Ouder de Nanny inhuurt voor minder dan 4 dagen per week oppaswerkzaamheden. De Ouder wordt dus werkgever van de Nanny nadat het boekingsverzoek is aanvaard en de Oppasovereenkomst tot stand is gekomen. De Nanny geeft zelf zijn/haar inkomsten op bij de Belastingdienst. De Ouder draagt geen loonbelasting af.
4. De Ouder en de Nanny verplichten zich over en weer de informatie omtrent de Regeling en de gevolgen van de toepasselijkheid van deze Regeling goed te lezen.
5. De Oppas kan naar eigen inzicht oppasverzoeken accepteren of afwijzen en stelt zelf in welke vergoeding hij of zij voor de Oppasdienst wenst te ontvangen. De Ouder is gerechtigd instructies te geven aan de Nanny. Hotdoghouse Curated Dog Nanny heeft over de te leveren hondenoppasdiensten tussen Ouder en Nanny geen enkele zeggenschap.
6. Hotdoghouse Curated Dog Nanny faciliteert de betalingen van de Ouders aan de betreffende Nanny middels de Payment Provider.
7. Het is de Ouder niet toegestaan een Nanny, die door het Platform bij Ouder bekend is geworden, buiten het Platform om te contacteren en/of te boeken.
Artikel 4: Beoordelingen door Ouder van de Oppas
1. De Ouder kan op het Platform beoordelingen en recensies achterlaten over de Oppas (Dog Nanny).
2. Beoordelingen moeten op aantoonbare feiten berusten. De Ouder dient de Oppas naar redelijkheid en billijkheid en zo objectief mogelijk te beoordelen. Het is de Ouder niet toegestaan beledigingen, smaad, laster, privacygevoelige of andersoortige inhoud te plaatsen die in strijd is met de goede zeden of die anderszins onrechtmatig zijn. Beoordelingen die niet aan deze vereisten voldoen, zullen worden verwijderd. Beoordelingen geven te allen tijde de persoonlijke uitingen van de Ouder weer en nimmer uitingen van Hotdoghouse Curated Dog Nanny. Hotdoghouse Curated Dog Nanny controleert beoordelingen steekproefsgewijs.
3. De Ouder geeft Hotdoghouse Curated Dog Nanny met het inzenden van de beoordeling kosteloos, ongelimiteerd naar tijd en omvang, het gebruiksrecht van zijn beoordelingstekst. Hotdoghouse Curated Dog Nanny is gerechtigd vrij over de beoordeling te beschikken en deze in het bijzonder voor verdere
beoordelingsdiensten te bewerken en te gebruiken. De beoordelingen worden via het Platform gepubliceerd en kunnen aan derden worden verstrekt.
4. Het is verboden om met ongerechtvaardigde herhaaldelijke beoordelingen, zelfbeoordeling of andere beoordelingswijzen het beoordelingssysteem te beïnvloeden.
Artikel 5: Aansprakelijkheid van Hotdoghouse Curated Dog Nanny
1. Hotdoghouse Curated Dog Nanny is niet verantwoordelijk en/of aansprakelijk voor de al dan niet (deugdelijke) uitvoering en/of voltooiing van de Oppasovereenkomst door de Oppas en/of de Ouder. De Oppasovereenkomst is een overeenkomst tussen de Oppas en de Ouder zelf, waarbij Hotdoghouse Curated Dog Nanny niet als partij betrokken is.
2. Hotdoghouse Curated Dog Nanny is niet aansprakelijk en/of verantwoordelijk voor het al dan niet van toepassing zijn van de Regeling en de (mogelijke) dan wel het bestaan van een ‘reguliere arbeidsovereenkomst’ tussen de gebruiker en de Oppas en de gevolgen daarvan, waaronder maar niet beperkt tot enige verplichting tot het voldoen van (inkomsten)belasting. Meer concreet is Hotdoghouse Curated Dog Nanny dus niet verantwoordelijk of aansprakelijk voor enige (i) herkwalificatie van de relatie tussen de Ouder en de Oppas en/of (ii) arbeidsrechtelijke of andere verplichting van de Ouder ten opzichte van de Oppas (waaronder, maar niet uitsluitend, eventuele bijzondere verplichtingen op grond van de Regeling of
eventuele (fiscale en civiele) verplichtingen als gevolg van het bestaan van een reguliere arbeidsovereenkomst).
3. Hotdoghouse Curated Dog Nanny zal haar verplichtingen uit hoofde van de Gebruikersovereenkomst naar haar beste vermogen uitvoeren en daarbij zorgvuldigheid in acht nemen tegenover de Gebruiker en derden. Mocht de Gebruiker schade lijden door enige tekortkoming in de uitvoering van de Gebruikersovereenkomst, dan is Hotdoghouse Curated Dog Nanny jegens Gebruiker echter slechts aansprakelijk voor de schade die de Gebruiker daardoor lijdt in geval van opzet of grove nalatigheid van de zijde van Hotdoghouse Curated Dog Nanny. Een eventuele aansprakelijkheid van Hotdoghouse Curated Dog Nanny tegenover de Gebruiker en/of derden voor schade, voortvloeiende uit of verband houdende met de uitvoering van deze Gebruikersovereenkomst, is beperkt tot maximaal drie keer de waarde van de laatstelijk geboekte Oppasdienst of het bedrag dat in het desbetreffende geval uit hoofde van de door Hotdoghouse Curated Dog Nanny gesloten aansprakelijkheidsverzekering(en) door haar verzekeraar wordt of kan worden uitbetaald.
4. Hotdoghouse Curated Dog Nanny is nimmer aansprakelijk voor indirecte schade, daaronder begrepen gevolgschade, gederfde winst, gemiste besparingen, en schade door verlies van gegevens, op enige wijze ontstaan door en/of voortvloeiend uit het gebruik van het Platform.
5. Meer in het bijzonder zal Hotdoghouse Curated Dog Nanny in geen geval aansprakelijk zijn voor welke schade dan ook, die op enige wijze ontstaat door en/of voortvloeit uit:
○ Handelingen door de Gebruiker verricht, zoals het sluiten van een
Oppasovereenkomst, welke tot stand gekomen is door gebruikmaking van het Platform;
○ De onmogelijkheid de website/het Platform te gebruiken, welke
onmogelijkheid niet aan Hotdoghouse Curated Dog Nanny toe te rekenen is of gelegen is in het niet functioneren van de door Hotdoghouse Curated Dog Nanny gebruikte apparatuur, netwerken of software;
○ Het feit dat de website niet altijd en geheel foutloos werkt;
○ Het feit dat de informatie op de website en/of in het bestand onjuist, onvolledig of niet actueel is;
○ Het onrechtmatig gebruik van de systemen van Hotdoghouse Curated Dog Nanny, waaronder de website en het Platform, door een derde;
○ Handelingen van de Oppas nadat de Ouder daarmee een
Oppasovereenkomst heeft gesloten door gebruikmaking van het Platform.
Indien er aansprakelijkheid bestaat voor letselschade en/of dood, is deze in elk geval gemaximeerd tot een bedrag van €2.000.
Artikel 6: Aansprakelijkheid van de Gebruiker en belastingen
1. De Gebruiker is aansprakelijk voor alle schade die Hotdoghouse Curated Dog Nanny lijdt wegens contractbreuk/schending van de Gebruikersovereenkomst. De Gebruiker vrijwaart Hotdoghouse Curated Dog Nanny voor alle schade die Hotdoghouse Curated Dog Nanny wordt toegebracht door mogelijke claims van derde partijen als gevolg van het gebruik van het Platform.
2. De Gebruiker is zelf verantwoordelijk voor het sluiten van een wettelijke aansprakelijkheids- en ongevallenverzekering en het sluiten van de
Oppasovereenkomst. Hotdoghouse Curated Dog Nanny beveelt de Gebruiker aan de verzekeringspolissen zorgvuldig te controleren en wijst de Gebruiker er in het bijzonder op dat deze op de hoogte dient te zijn van en inzicht dient te hebben in eventuele uitsluitingen en aftrekposten die van toepassing zijn op een dergelijke verzekering.
3. De Oppas blijft te allen tijde aansprakelijk en vrijwaart Hotdoghouse Curated Dog Nanny voor alle aanspraken van de Belastingdienst in verband met enige uitoefening van een Oppasovereenkomst en vrijwaart Hotdoghouse Curated Dog Nanny tegen aanspraken van de Belastingdienst in dat kader. Indien en voor zover Hotdoghouse Curated Dog Nanny aansprakelijk zou worden gesteld voor belastingen en/of sociale premies, zal de Oppas Hotdoghouse Curated Dog Nanny vrijwaren en schadeloos stellen voor alle belastingen en/of sociale premies.
4. Indien partijen zich niet aan de Regeling (er wordt bijvoorbeeld meer opgepast dan 4 dagen per week) kunnen het zijn dat (ook) de Ouder wordt aangesproken door de Belastingdienst. Indien en voor zover Hotdoghouse Curated Dog Nanny aansprakelijk zou worden gesteld voor belastingen en/of sociale premies, zal de Ouder Hotdoghouse Curated Dog Nanny vrijwaren en schadeloos stellen voor alle belastingen en/of sociale premies.
Artikel 7: Herroeping, wijzigingen, looptijd en opzegging van Gebruikersovereenkomst
1. De Gebruiker kan binnen veertien dagen na de dag waarop de
Gebruikersovereenkomst tot stand is gekomen, deze ontbinden c.q. herroepen zonder opgave van reden.
2. Deze ontbinding c.q. herroeping kan plaatsvinden door Hotdoghouse Curated Dog Nanny duidelijk per e-mail daarvan in kennis te stellen. Indien met de uitvoering van de diensten onder de Gebruikersovereenkomst en/of met de oppaswerkzaamheden conform de Oppasovereenkomst op verzoek van de Ouder is begonnen binnen
voormelde termijn van veertien dagen, draagt de Ouder de kosten voor het reeds genoten gebruik van de oppasdiensten.
3. Hotdoghouse Curated Dog Nanny is gerechtigd de Gebruikersvoorwaarden in overeenstemming met de wettelijke voorschriften te wijzigen. Dergelijke wijzigingen gelden als door Gebruiker aangenomen en treden onder de lopende
Gebruikersovereenkomst in werking, indien Hotdoghouse Curated Dog Nanny de wijziging aan Gebruiker in tekstvorm meedeelt en Gebruiker deze wijzigingen niet binnen vier weken vanaf de ontvangst van de mededeling heeft weersproken. Van wijzigingen gaat geen terugwerkende kracht uit (wijzigingen gelden altijd voor de toekomst).
4. De looptijd van de Gebruikersovereenkomst is onbeperkt; de
Gebruikersovereenkomst is voor onbepaalde tijd gesloten. De
Gebruikersovereenkomst kan door Gebruiker of Hotdoghouse Curated Dog Nanny met inachtneming van een opzegtermijn van twee weken tegen het eind van de maand schriftelijk worden opgezegd. Onverminderd het bepaalde in dit lid bestaat het recht tot onmiddellijke beëindiging/opzegging van de Gebruikersovereenkomst vanwege zwaarwegende redenen. Een beëindiging van de Gebruikersovereenkomst heeft op reeds gesloten Oppasovereenkomsten geen invloed.
5. Hotdoghouse Curated Dog Nanny rekent, afhankelijk van het gekozen
membership, transactiekosten per Oppasdienst. Eventuele transactiekosten zijn gekoppeld aan het tot stand komen van een transactie/Oppasdienst via het Platform en zijn dus verschuldigd ongeacht of en hoe uitvoering aan de Oppasdienst wordt gegeven. Indien de Ouder de Oppasdienst annuleert, blijven/zijn de transactiekosten dus verschuldigd aan Hotdoghouse Curated Dog Nanny (ongeacht het moment van annulering van de Oppasdienst). De transactiekosten zijn 10% per oppasdienst.
Artikel 8: Membership, gratis proefperioden, kosten, opzegging en tegoeden 1. Membership
Om als Ouder toegang te krijgen tot het Platform is het een vereiste een membership af te sluiten. Een mogelijkheid om als Ouder toegang te krijgen tot het Platform is het afsluiten van een membership dat met een gratis proefperiode kan beginnen en/of korting na invoer van een geldige actiecode, die maandelijks wordt voortgezet totdat de Ouder de Gebruikersovereenkomst opzegt of Hotdoghouse Curated Dog Nanny deze beëindigt. De Ouder kan onbeperkt een Oppas boeken via het Platform en betaalt daarnaast enkel transactiekosten na iedere Oppasdienst. Hotdoghouse Curated Dog Nanny biedt de Ouder het volgende membership:
Prijs per maand: EUR €52,-. Transactiekosten per dienst: 10% van de dienst
Het membership kan met een gratis proefperiode beginnen en is alleen bestemd voor nieuwe gebruikers en wordt maar éénmalig verstrekt. De gratis proefperiode duurt 14 dagen of zoveel dagen als aangegeven tijdens de registratie. Hotdoghouse Curated Dog Nanny behoudt zich het recht voor om geheel naar eigen inzicht te bepalen of de Ouder in aanmerking komt voor de gratis proefperiode. De Ouder ontvangt geen bericht op het moment dat de gratis proefperiode is afgelopen of dat het betalende gedeelte van het membership is ingegaan.
2. Oppas tegoeden
Hotdoghouse Curated Dog Nanny verstrekt persoonlijke giftcodes met oppastegoeden. Een oppastegoed kan voor commerciële doeleinden worden versterkt aan (potentiële) gebruikers of worden verkocht/gekocht om als gift(card) te worden verstrekt. Hotdoghouse Curated Dog
Nanny zal in het geval van een gift(card) een persoonlijke giftcode verstrekken met daarop een oppastegoed waarvan de hoogte ervan nader te bepalen is door koper. Het oppastegoed kan enkel worden besteed aan kosten die gerelateerd zijn aan de Oppas bij de betreffende Oppasdienst. Dus transactiekosten, abonnementskosten of eenmalige boekingskosten kunnen hier niet van worden betaald. Een giftcode moet worden ingevoerd voordat de Ouder gaat boeken en de Oppas heeft geaccepteerd. Het tegoed wordt na de eerstvolgende Oppasdienst bij de afrekening in mindering gebracht op het totaalbedrag. Een giftcode is éénmalig bruikbaar. Wanneer het totaalbedrag (exclusief transactiekosten) voor de betreffende Oppasdienst lager is dan het tegoed, zal het gedeelte van het tegoed dat niet gebruikt is teniet gaan. Wanneer een boeking wordt geannuleerd of gecanceld blijft het tegoed staan. Bij een daaropvolgende boeking hoeft de code niet (nogmaals) worden ingevoerd. Een code is alleen bruikbaar in gebieden waar Hotdoghouse Curated Dog Nanny actief is. De code is niet overdraagbaar en er is geen restitutie mogelijk en ongebruikte tegoeden worden niet teruggenomen.
3. Membership opzeggen
De Ouder dient het abonnement/membership in overeenstemming met artikel 7.4 van deze Gebruikersvoorwaarden op te zeggen voordat dit maandelijks wordt verlengd om te voorkomen dat de abonnementskosten voor de daaropvolgende maand in rekening worden gebracht. In het Platform, onder ‘mijn betalingen’ > ‘membership’ > huidige abonnement ‘abonnement opzeggen’, kan de Ouder het abonnement opzeggen.
4. Recht op intrekking
De Ouder verleent expliciet toestemming voor het feit dat het membership (abonnement) direct ingaat wanneer de Ouder tijdens de registratie, na koppeling van de bankgegevens, op voltooien klikt. Hiermee krijgt de Ouder direct toegang tot het Platform en kan in feite direct een boekingsaanvraag verstuurd worden. De Ouder stemt er bovendien mee in dat het recht op kosteloze herroeping dan verloren gaat; voor de tijd dat de Ouder gebruik heeft gemaakt van het Platform, zal hij/zij een vergoeding pro rata verschuldigd zijn. Dit heeft geen invloed op het recht om het abonnement op enig moment op te zeggen.
5. Kosten na iedere Oppasdienst voor de Ouder
Hotdoghouse Curated Dog Nanny rekent bij een abonnement (met uitzondering van Premium) transactiekosten voor iedere Oppasdienst (ook bij een annulering). De hoogte van de transactiekosten zijn terug te vinden op de website onder ‘Tarief’.
Artikel 9: Facturering
1. Facturering abonnement:
De Ouder verleent middels het kiezen voor een membership aan Hotdoghouse Curated Dog Nanny de autorisatie om maandelijks vooraf de abonnementskosten tegen het dan geldende tarief af te schrijven via haar Payment Provider. De Ouder autoriseert Hotdoghouse Curated
Dog Nanny om dergelijke variërende bedragen, die maandelijks in één of meerdere keren kunnen worden gefactureerd, in rekening te brengen via haar Payment Provider.
2. Facturering na Oppasdienst
Hotdoghouse Curated Dog Nanny krijgt de autorisatie om na voltooiing van iedere Oppasovereenkomst de (door)betalingen namens de Ouder, namelijk het verschuldigde loon (d.w.z. het tussen de Ouder en de Oppas afgesproken uurtarief vermenigvuldigd met de oppasduur) PLUS de eventuele transactiekosten voor Hotdoghouse Curated Dog Nanny, af te schrijven via de Payment Provider. De Ouder autoriseert Hotdoghouse Curated Dog Nanny hierbij om dergelijke variërende (door)betalingen namens de Oppas en voor zichzelf te incasseren via haar Payment Provider. De Oppas autoriseert Hotdoghouse Curated Dog Nanny hierbij om de door de Ouder ontvangen betalingen voor de Oppasdienst (met uitzondering van de transactiekosten) door te betalen aan de Oppas via haar Payment Provider.
3. Prijswijzigingen / tariefswijziging
Hotdoghouse Curated Dog Nanny behoudt zich het recht voor om geheel naar eigen
goeddunken prijzen voor de service van het Platform en onderdelen hiervan op enigerlei wijze en te allen tijde te wijzigen. Prijswijzigingen voor de service/het membership gaan pas na minimaal 14 dagen in, nadat de Ouder via e-mail een kennisgeving heeft ontvangen.
4. Factureringscyclus
De abonnementskosten voor gebruik van het Platform worden in rekening gebracht aan het begin van het betaalde gedeelte van het abonnement en elke maand daarna, tenzij en totdat de Ouder het abonnement opzegt. Hotdoghouse Curated Dog Nanny brengt de kosten elke maand automatisch via haar Payment Provider in rekening op de kalenderdag die overeenkomt met het begin van het betaalde abonnement. Abonnementskosten worden volledig geïncasseerd op het moment van betaling. Hotdoghouse Curated Dog Nanny behoudt zich via haar Payment Provider het recht voor om het tijdstip van de facturering te wijzigen, met name, zoals hieronder is aangegeven, als het bedrag niet in rekening kan worden gebracht. Als het betalende abonnement is ingegaan op een dag die niet in een bepaalde maand valt, kan Hotdoghouse Curated Dog Nanny de kosten in rekening brengen via haar Payment Provider op een dag in de toepasselijke maand of een andere dag die Hotdoghouse Curated Dog Nanny geschikt acht. Bijvoorbeeld: Gebruiker start abonnement op 31 januari, dan is de volgende betalingsdatum waarschijnlijk 28 februari en wordt via de Payment Provider op die datum geïncasseerd bij de Ouder. De verlengingsdatum kan veranderen door wijzigingen in het abonnement. ‘Facturering’ of ‘in rekening brengen’, zoals gebruikt in deze Gebruikersvoorwaarden, betekent een afschrijving, debitering of andere betalingsvereffening via de Payment Provider. Tenzij anderszins is vermeld, verwijst maand of maandelijks naar de factureringscyclus.
5. Geen terugbetalingen
Hotdoghouse Curated Dog Nanny verricht geen terugbetaling of creditering voor gedeeltelijk (on)gebruikte abonnements/membershipsperioden. Na opzegging van een abonnement blijft de Ouder toegang behouden tot de service tot het einde van de laatste factureringsperiode.
Artikel 10: Toepasselijk recht, bevoegdheid rechter, nietigheid en recht tot wijziging
1. Nederlands recht is van toepassing op de Gebruikersovereenkomst en deze Gebruikersvoorwaarden.
2. In geval van geschillen tussen Hotdoghouse Curated Dog Nanny en de Gebruiker zullen deze worden voorgelegd en beslecht door de bevoegde rechter te Amsterdam.
3. Mocht een van deze bepalingen om wat voor reden dan ook nietig blijken te zijn, dan laat dit de geldigheid van de overige bepaling(en) in deze Gebruikersvoorwaarden onverlet.
4. Hotdoghouse Curated Dog Nanny heeft het recht deze Gebruiksvoorwaarden van tijd tot tijd te wijzigen.

Article 1: Definitions and General Provisions
The following terms/definitions are used in these Terms of Use:
Hotdoghouse Curated Dog Nanny: Hotdoghouse B.V., located at [address], with Chamber of Commerce number 89066677, tel. [phone number], email: info@hotdoghouse.nl. Hotdoghouse Curated Dog Nanny manages the website/online platform www.hotdoghouse.com for (flexible) dog sitting services, also referred to as the Platform.
User: Any dog owner (Parent) and any dog sitter (Nanny) who has registered on the Platform and uses the facilities of the Platform.
User Profile: The online profile with which the User registers on the Platform.
User Agreement: Any agreement between Hotdoghouse Curated Dog Nanny and the User, which is automatically concluded at the time of registration by the User on the Platform, on the basis of which Hotdoghouse Curated Dog Nanny grants the User access to the Platform and allows the User to use the facilities of the Platform. The User Agreement is a distance contract and does not entail a separate written agreement between Hotdoghouse Curated Dog Nanny and the User.
Terms of Use: These general terms and conditions, i.e., the conditions that apply to any use (both via computer and mobile devices or any other software application) of the Platform by a User and (therefore) also to the User Agreement.
Nanny: An individual who has registered on the Platform and can provide flexible dog sitting services through the Platform.
Sitting Agreement: The agreement(s) related to a dog sitting service between the Parent and the Nanny, concluded through the Platform.
Sitting Service: Any dog sitting service (to be provided or already provided) under the Sitting Agreement, established via the Platform, which involves a Nanny taking care of one or more dogs of the Parent(s).
Parent(s): The owner(s) of the dogs, who are private individuals and have registered on the Platform.
Payment Provider: The payment service provider engaged by Hotdoghouse Curated Dog Nanny, currently [payment provider name], which handles the payment transactions through the Platform for Sitting Services arranged via the Platform.
Platform: The online platform www.hotdoghouse.com for dog sitting services of Hotdoghouse Curated Dog Nanny.
Completed (or completed Sitting Service): The completion (and thus the end) of the Sitting Service by the Nanny.
These Terms of Use apply to every use of the Platform and to every offer and/or further
(User) agreement between Hotdoghouse Curated Dog Nanny and a User, unless the parties have explicitly and in writing deviated from these terms.
Hotdoghouse Curated Dog Nanny offers its Platform, among other things, to match supply and demand in the field of dog sitting services by Users. Hotdoghouse Curated Dog Nanny also facilitates the connection between Parents and Nannies via the Platform, with the help
of an automated search module, where the Parent and Nanny can come to an offer and acceptance (regarding a Sitting Service). Through the Platform, the Parent can also proceed to payment. Hotdoghouse Curated Dog Nanny only provides the Platform and the automated search engine. Hotdoghouse Curated Dog Nanny and/or its employees do not provide dog sitting services themselves.
Article 2: User Agreement, Registration, and Use
Before the User Agreement is concluded between the parties, the text of these general terms and conditions is made available to the User.
The text of these User Terms is provided to the User electronically in such a way that it can be easily stored by the User. If this is not reasonably possible, it will be indicated, before the User Agreement is concluded, how the User can access the User Terms electronically and that they will be sent to the User at no cost, either electronically or otherwise, upon request. These User Terms are fully applicable to each User Agreement and are accepted by the User through registration on the Platform.
The User fills in the User Profile truthfully, accurately, and completely, accepts the User Terms and the privacy statement of Hotdoghouse Curated Dog Nanny, and makes the User Profile available to Hotdoghouse Curated Dog Nanny for further processing on the Platform. The User is required to provide all relevant information that is requested from them. The Parent must choose a membership. The Nanny must specify their rates in the User Profile and is responsible for determining those rates. The User is responsible for keeping the User Profile up to date.
Hotdoghouse Curated Dog Nanny’s collection and use of (personal) information related to access to and use of the Platform is described in the privacy statement. Hotdoghouse Curated Dog Nanny will store this data, including information about services booked or provided by the User, in the User Profile for the duration of the User Agreement and will offer the User the possibility to modify personal data. The User can access this section of the Platform by logging in with their personal email address and password. Hotdoghouse Curated Dog Nanny will then send an (automatic) email confirming the registration of the User, the chosen membership (if applicable), and the acceptance by the User of the User Terms and the privacy statement. With the registration, the User Agreement is automatically concluded between the User and Hotdoghouse Curated Dog Nanny, to which these User Terms apply.
The User has the possibility to edit their User Profile and (if applicable) choose a different membership. The User is responsible for the accuracy and completeness of the data in the User Profile.
The User Profile and the User Agreement are not transferable to third parties. Each User is only allowed to use one User Profile. Hotdoghouse Curated Dog Nanny reserves the right to delete a User Profile and deny the User access to the Platform without providing a reason. A deleted User is not allowed to create a new User Profile without prior written consent from Hotdoghouse Curated Dog Nanny.
Hotdoghouse Curated Dog Nanny is entitled at all times, without providing a reason, to change, remove, or introduce new functions on the Platform (e.g., by making certain features
available only under specific conditions).
Article 3: Explanation of the Nanny Agreement
Hotdoghouse Curated Dog Nanny offers Parents the opportunity, for a fee, to register with a User Profile, use the Platform to search for a Nanny through the automated search module, and submit booking requests to a Nanny. The Platform allows the Nanny to indicate the dates and times they are available to provide dog-sitting services.
The Platform automatically forwards the Parent's booking request to the relevant Nanny. The requested Nanny determines entirely autonomously whether they will fulfill the dog-sitting service in accordance with the booking request. The Parent will provide instructions to the Nanny regarding the services to be performed. Hotdoghouse Curated Dog Nanny does not guarantee (and cannot guarantee) that booking requests from Parents will be fulfilled and cannot be held liable for this. If a Nanny declines the booking request, the Parent can search for and book another suitable Nanny through the Platform.
The Nanny will provide the dog-sitting service based on a (special) employment contract under the Home Services Scheme, assuming that the Parent hires the Nanny for less than 4 days per week of dog-sitting work. The Parent thus becomes the employer of the Nanny once the booking request has been accepted and the Nanny Agreement has been concluded. The Nanny reports their own income to the Tax Authority. The Parent does not withhold wage taxes.
The Parent and the Nanny commit to reading the information about the Scheme and understanding the consequences of its applicability.
The Nanny can choose to accept or reject dog-sitting requests at their discretion and sets the compensation they wish to receive for the dog-sitting service. The Parent is entitled to give instructions to the Nanny. Hotdoghouse Curated Dog Nanny has no control over the dog-sitting services provided between the Parent and the Nanny.
Hotdoghouse Curated Dog Nanny facilitates payments from the Parent to the Nanny through the Payment Provider.
It is not allowed for the Parent to contact or book a Nanny, who was introduced to the Parent through the Platform, outside the Platform.
Article 4: Reviews by the Parent of the Babysitter
1. The Parent can leave reviews and ratings about the Babysitter on the Platform. 2. Reviews must be based on verifiable facts. The Parent should assess the Babysitter reasonably, fairly, and as objectively as possible. The Parent is not allowed to post insults, defamation, slander, privacy-sensitive, or any other inappropriate content (content that violates public morals or is otherwise unlawful). Reviews that do not meet these requirements will be removed. Reviews always reflect the opinions of the Parent and never the opinions of Charly Cares. Charly Cares monitors reviews on a random basis.
3. By submitting the review, the Parent grants Charly Cares a non-exclusive, unlimited, perpetual right to use their review text free of charge, both in terms of time and scope. Charly Cares is entitled to freely dispose of the review and in particular to edit and use it for further review services. The reviews are published via the Platform and may be shared with third parties.
4. It is prohibited to influence the review system with unjustified repetitive reviews, self-reviews, or other methods of manipulation.
Article 5: Liability of Hotdoghouse Curated Dog Nanny
Hotdoghouse Curated Dog Nanny is not responsible and/or liable for the (proper) execution and/or completion of the Nanny Agreement by the Nanny and/or the Parent. The Nanny Agreement is an agreement between the Nanny and the Parent themselves, in which Hotdoghouse Curated Dog Nanny is not involved as a party.
Hotdoghouse Curated Dog Nanny is not liable and/or responsible for the applicability of the Scheme and the (possible) existence of a 'regular employment contract' between the user and the Nanny and the consequences thereof, including but not limited to any obligation to pay (income) taxes. More specifically, Hotdoghouse Curated Dog Nanny is not responsible or liable for any (i) requalification of the relationship between the Parent and the Nanny and/or (ii) labor law or other obligations of the Parent toward the Nanny (including, but not limited to, any special obligations under the Scheme or any (tax and civil) obligations due to the existence of a regular employment contract).
Hotdoghouse Curated Dog Nanny will fulfill its obligations under the User Agreement to the best of its ability and will exercise care toward the User and third parties. However, if the User suffers damage due to any shortcoming in the execution of the User Agreement, Hotdoghouse Curated Dog Nanny will only be liable for the damage suffered by the User in the case of intent or gross negligence on the part of Hotdoghouse Curated Dog Nanny. Any potential liability of Hotdoghouse Curated Dog Nanny toward the User and/or third parties for damages arising from or in connection with the execution of this User Agreement is limited to a maximum of three times the value of the last booked Nanny service or the amount that, in the relevant case, is or can be paid by its insurer under the liability insurance(s) taken out by Hotdoghouse Curated Dog Nanny.
Hotdoghouse Curated Dog Nanny is never liable for indirect damages, including consequential damages, lost profits, lost savings, and damage due to loss of data, arising in any way from or related to the use of the Platform.
More specifically, Hotdoghouse Curated Dog Nanny will in no case be liable for any damage arising in any way from or resulting from:
● Actions performed by the User, such as entering into a Nanny Agreement, which was concluded through the use of the Platform;
● The inability to use the website/Platform, if this inability is not attributable to Hotdoghouse Curated Dog Nanny or is caused by the malfunctioning of the equipment, networks, or software used by Hotdoghouse Curated Dog Nanny;
● The fact that the website does not always and completely function error-free; ● The fact that the information on the website and/or in the file is incorrect, incomplete, or outdated;
● The unlawful use of Hotdoghouse Curated Dog Nanny’s systems, including the website and the Platform, by a third party;
● Actions of the Nanny after the Parent has entered into a Nanny Agreement by using the Platform.
If liability exists for personal injury and/or death, it is in any case capped at an amount of €5,000.
Article 6: Liability of the User and Taxes
The User is liable for all damages suffered by Hotdoghouse Curated Dog Nanny due to
breach of contract/violation of the User Agreement. The User indemnifies Hotdoghouse Curated Dog Nanny against all damages caused by potential claims from third parties resulting from the use of the Platform.
The User is responsible for obtaining liability and accident insurance and entering into the Nanny Agreement. Hotdoghouse Curated Dog Nanny recommends that the User carefully check their insurance policies and specifically draws the User’s attention to the need to be
aware of and have insight into any exclusions and deductions that may apply to such insurance.
The Nanny remains liable at all times and indemnifies Hotdoghouse Curated Dog Nanny from all claims from the Tax Authority related to any execution of a Nanny Agreement and indemnifies Hotdoghouse Curated Dog Nanny against claims from the Tax Authority in this context. If and to the extent that Hotdoghouse Curated Dog Nanny is held liable for taxes and/or social security contributions, the Nanny will indemnify and hold Hotdoghouse Curated Dog Nanny harmless for all taxes and/or social security contributions.
If the parties do not comply with the Scheme (e.g., if more than 4 days of dog-sitting per week are provided), it is possible that the Parent will also be approached by the Tax Authority. If and to the extent that Hotdoghouse Curated Dog Nanny is held liable for taxes and/or social security contributions, the Parent will indemnify and hold Hotdoghouse Curated Dog Nanny harmless for all taxes and/or social security contributions.
Article 7: Revocation, Modifications, Duration, and Termination of the User Agreement
The User may terminate or revoke the User Agreement within fourteen days from the day the agreement was concluded, without providing any reason.
This termination or revocation can be done by clearly notifying Hotdoghouse Curated Dog Nanny by email. If the services under the User Agreement and/or the dog-sitting duties under the Nanny Agreement have already started at the request of the Parent within the aforementioned fourteen-day period, the Parent shall bear the costs for the services already used.
Hotdoghouse Curated Dog Nanny is entitled to modify the User Terms in accordance with legal regulations. Such modifications will be deemed accepted by the User and will come into effect under the ongoing User Agreement if Hotdoghouse Curated Dog Nanny informs the User in writing of the change, and the User does not object to the changes within four weeks of receiving the notice. Modifications will not have retroactive effect (modifications always apply from the future).
The duration of the User Agreement is indefinite; the User Agreement is concluded for an indefinite period. The User Agreement can be terminated by either the User or Hotdoghouse Curated Dog Nanny with a two-week notice period before the end of the month in writing. Notwithstanding the provisions of this paragraph, there is the right to immediate termination of the User Agreement for compelling reasons. Termination of the User Agreement will not affect previously concluded Nanny Agreements.
Hotdoghouse Curated Dog Nanny charges, depending on the selected membership, transaction fees per Nanny service. Any transaction fees are linked to the creation of a transaction/Nanny service through the Platform and are therefore due regardless of whether or how the Nanny service is performed. If the Parent cancels the Nanny service, the transaction fees are still owed to Hotdoghouse Curated Dog Nanny (regardless of the cancellation time of the Nanny service). The transaction fee is 10% per Nanny service.
Article 8: Membership, Free Trial Periods, Costs, Termination, and Credits 1. Membership
To access the Platform as a Parent, it is required to subscribe to a membership. One way for a Parent to access the Platform is by subscribing to a membership that may begin with a free trial period and/or a discount upon entering a valid promotional code, continuing monthly until the Parent terminates the User Agreement or Hotdoghouse Curated Dog Nanny terminates it. The Parent can book unlimited Nanny services via the Platform and only pays transaction fees after each Nanny service. Hotdoghouse Curated Dog Nanny offers the following membership: ● Price per month: EUR €52.
● Transaction fees per service: 10% of the service.
The membership may begin with a free trial period and is only intended for new users and is provided only once. The free trial period lasts 14 days or the number of days indicated during registration. Hotdoghouse Curated Dog Nanny reserves the right to determine at its discretion whether the Parent qualifies for the free trial period. The Parent will not receive a notification when the free trial period ends or when the paid part of the membership begins.
2. Nanny Credits
Hotdoghouse Curated Dog Nanny provides personal gift codes with nanny credits. A nanny credit can be strengthened for commercial purposes to (potential) users or sold/bought to be given as a gift (card). In the case of a gift (card), Hotdoghouse Curated Dog Nanny will provide a personal gift code with a nanny credit, the amount of which will be determined by the buyer. The nanny credit can only be spent on costs related to the Nanny for the relevant Nanny service. Therefore, transaction fees, subscription fees, or one-time booking fees cannot be paid from this credit. A gift code must be entered before the Parent proceeds to book and before the Nanny has accepted. The credit will be deducted from the total amount at the checkout after the first Nanny service. A gift code is only valid once. If the total amount (excluding transaction fees) for the relevant Nanny service is lower than the credit, the unused portion of the credit will be forfeited. If a booking is canceled, the credit remains. For any subsequent booking, the code does not need to be entered again. A code is only usable in areas where Hotdoghouse Curated Dog Nanny is active. The code is non-transferable, and no refunds are available, and unused credits are not refundable.
3. Termination of Membership
The Parent must terminate the subscription/membership in accordance with Article 7.4 of these User Terms before it is automatically renewed to avoid being charged the subscription fees for the following month. The Parent can terminate the membership under 'My Payments' > 'Membership' > 'Cancel Subscription' on the Platform. 4. Right to Withdraw
The Parent explicitly gives consent for the membership (subscription) to begin immediately when the Parent clicks "complete" during registration, after linking their bank details. This grants immediate access to the Platform, and the Parent can submit a booking request right away. The Parent also agrees that the right to a free revocation will be lost; for the time the Parent has used the Platform, they will owe a pro-rated fee. This does not affect the right to terminate the subscription at any time. 5. Costs After Each Nanny Service for the Parent
Hotdoghouse Curated Dog Nanny charges transaction fees for each Nanny service (even in the case of a cancellation) for a subscription (except for Premium). The transaction fees can be found on the website under 'Rates.'
Article 9: Invoicing
1. Subscription Invoicing
By choosing a membership, the Parent authorizes Hotdoghouse Curated Dog Nanny to charge the monthly subscription fees in advance at the applicable rate through its Payment Provider. The Parent authorizes Hotdoghouse Curated Dog Nanny to charge such varying amounts, which may be invoiced in one or more installments monthly, via its Payment Provider.
2. Invoicing After Nanny Service
Hotdoghouse Curated Dog Nanny is authorized to collect the (pay) payments on behalf of the Parent after the completion of each Nanny Agreement, namely the agreed wage (i.e., the hourly rate agreed upon between the Parent and the Nanny multiplied by the duration of the dog-sitting) PLUS any applicable transaction fees for Hotdoghouse Curated Dog Nanny, via the Payment Provider. The Parent authorizes Hotdoghouse Curated Dog Nanny to collect such varying (pay) payments on behalf of the Nanny and for itself via its Payment Provider. The Nanny authorizes Hotdoghouse Curated Dog Nanny to pass on the payments received from the Parent for the Nanny service (excluding transaction fees) to the Nanny via its Payment Provider.
3. Price Changes / Rate Modifications
Hotdoghouse Curated Dog Nanny reserves the right to change prices for the Platform's service and components in any way and at any time at its discretion. Price changes for the service/membership will only take effect after at least 14 days, following the Parent receiving an email notification.
4. Billing Cycle
The subscription fees for using the Platform are charged at the beginning of the paid portion of the subscription and every month thereafter unless and until the Parent cancels the subscription. Hotdoghouse Curated Dog Nanny automatically charges the fees every month via its Payment Provider on the calendar day corresponding to the start of the paid subscription. Subscription fees are collected in full at the time of payment. Hotdoghouse Curated Dog Nanny reserves the right, via its Payment Provider, to change the billing time, particularly if the amount cannot be charged. 5. No Refunds
Hotdoghouse Curated Dog Nanny does not issue refunds or credits for partially (un)used subscription/membership periods. After cancellation of a subscription, the Parent retains access to the service until the end of the last billing period.
Article 10: Applicable Law, Competent Court, Invalidity, and Right to Modify
1. Dutch law applies to the User Agreement and these User Terms.
2. In case of disputes between Hotdoghouse Curated Dog Nanny and the User, they will be submitted to and resolved by the competent court in Amsterdam.
3. If any of these provisions are deemed invalid for any reason, the validity of the remaining provisions of these User Terms will remain unaffected.
4. Hotdoghouse Curated Dog Nanny reserves the right to modify these Terms of Use from time to time.
